CERTIRIDE TERMS OF SERVICE
IMPORTANT: CertiRide is a driver-distraction reduction tool. It is not a substitute for responsible driving, good judgment, compliance with traffic laws, or appropriate supervision.
1. ACCEPTANCE OF TERMS
By creating an account, accessing CertiRide, or using CertiRide, you agree to these Terms of Service.
If you do not agree, do not use CertiRide.
2. PURPOSE OF CERTIRIDE
CertiRide is designed to help reduce mobile-device distraction by detecting driving-related conditions and restricting access to selected applications.
CertiRide does not guarantee that distracted driving will be prevented.
3. DRIVER RESPONSIBILITY
The driver is solely responsible for safely operating the vehicle and complying with applicable laws.
You must not attempt to configure, disable, troubleshoot, certify passenger status, or otherwise interact with CertiRide while operating a vehicle.
Safely stop and park the vehicle before interacting with the device when necessary.
4. TECHNOLOGY LIMITATIONS
CertiRide depends on Android, device hardware, sensors, permissions, operating-system services, network connectivity, third-party services, and other technologies outside CertiRide's direct control.
To provide driving-detection functionality, CertiRide may operate a foreground service, display an ongoing system notification, access permitted location information while the application interface is not visible, and attempt to restore driving monitoring after the device restarts when required permissions remain enabled.
Features may therefore occasionally be delayed, unavailable, inaccurate, interrupted, terminated by the operating system, or behave differently across devices.
5. PASSENGER CERTIFICATION
CertiRide may permit a person to certify that they are a passenger.
Passenger certification must only be used when the device user is genuinely a passenger and it is safe and lawful to use the device.
Users must not falsely certify passenger status to circumvent driving restrictions.
6. ACCOUNT SECURITY
You are responsible for maintaining the security of your CertiRide account and device.
Do not share passwords, verification codes, or other authentication credentials with unauthorized persons.
7. HOUSEHOLD FEATURES
CertiRide may permit users to create or participate in households or other managed groups.
Users are responsible for ensuring they have appropriate authority to enroll, configure, or manage devices and accounts belonging to other individuals.
8. PROHIBITED USE
You may not intentionally defeat, bypass, reverse engineer, interfere with, misuse, or exploit CertiRide or use CertiRide for unlawful purposes.
9. BETA SOFTWARE
Beta versions of CertiRide are provided for testing and evaluation.
Beta software may contain errors, incomplete functionality, compatibility problems, interruptions, or other defects.
Users should not rely upon beta software as the sole method of preventing distracted driving or ensuring personal safety.
10. NO GUARANTEE
CertiRide does not guarantee uninterrupted operation, detection of every driving event, blocking of every application, prevention of unauthorized device use, or prevention of accidents, injuries, losses, or damages.
11. THIRD-PARTY SERVICES
CertiRide may depend upon third-party platforms and services, including Android and cloud infrastructure.
CertiRide is not responsible for outages, defects, security incidents, or changes caused solely by independent third-party services outside CertiRide's reasonable control.
12. CHANGES TO CERTIRIDE
Features may be added, modified, restricted, suspended, or removed as CertiRide develops.
13. CHANGES TO THESE TERMS
These Terms may be revised periodically.
When a material revision requires renewed acceptance, CertiRide may require you to accept the new version before continuing to use the service.
14. DISCLAIMER
To the maximum extent permitted by applicable law, CertiRide is provided on an "as is" and "as available" basis without warranties not expressly provided in writing.
Nothing in these Terms excludes rights or liabilities that cannot legally be excluded.
15. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, CertiRide and its owners, developers, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of or inability to use CertiRide.
Nothing in these Terms is intended to waive or limit liability where such limitation is prohibited by law.
16. USER RESPONSIBILITY
You acknowledge that technology cannot replace attentive driving.
You remain responsible for decisions involving vehicle operation, device use, passenger certification, account configuration, and compliance with applicable law.
